gavel.gif (3462 bytes) Caps on Damages are unfair and ineffective

03/19/2003

Insurance companies and doctors in Pennsylvania mistakenly claim that capping awards for chronic suffering, acute pain, and loss of a loved one would solve the current medical malpractice insurance problem.  This is not true.  The insurance industry itself admits that so-called caps would not reduce doctors´┐Ż medical malpractice insurance premiums.

The Pennsylvania trial lawyers message is that caps of any  kind are unfair and will not fix the insurance crisis. To this end, we have prepared a statement on caps that includes recent newspaper articles and op-ed columns as well as research from consumer groups that support PaTLA's position.
