gavel.gif (3462 bytes) Caps on Damages are unfair and ineffective

03/19/2003

Insurance companies and doctors in Pennsylvania mistakenly claim that capping awards for chronic suffering, acute pain, and loss of a loved one would solve the current medical malpractice insurance problem.  This is not true.  The insurance industry itself admits that so-called caps would not reduce doctors medical malpractice insurance premiums.

The Pennsylvania trial lawyers message is that caps of any  kind are unfair and will not fix the insurance crisis. To this end, we have prepared a statement on caps that includes recent newspaper articles and op-ed columns as well as research from consumer groups that support PaTLA's position.
