Unemployment Compensation Opinion from Supreme Ct.

Limousine drivers are independent contractors under state’s Unemployment Compensation Law

(3/14/2006) - Feb. 28, 2006 Ruling from the Pennsylvania Supreme Court in Danielle Viktor Ltd. v. Department of Labor and Industry affirming the Commonwealth Court’s Order that held that “drivers are independent contractors” and, accordingly, that the Dept. of Labor and Industry, Bureau of Employer Tax Operations, “erred by characterizing drivers as employees and imposing unemployment compensation taxes” on limousine service companies.
