Amicus Update: State Supreme Court to hear appeal in Wirth

Is an HMO exempt from anti-subrogation provision of the MVFRL?

(10/17/2005) - The Pennsylvania Supreme Court is expected to hear oral argument today in Wirth v. Aetna U.S. Health Care on the issue of whether an HMO is exempt under the state’s Health Maintenance Act from complying with the anti-subrogation provision of the Pennsylvania Motor Vehicle Financial Responsibility Law. The Pennsylvania Trial Lawyers Association has entered appearance as amicus in support of Wirth’s appeal.

According to the Court’s argument list, Wirth is listed ninth on the docket.
