Home News & Case Notes Laches not a subrogation defense (6/27/2005)--The Commonwealth Court has ruled that laches is not a defense to an employer's right to subrogation. The court also ruled that the right to subrogation against the workers' comp recipient's third-party settlement is absolute. The court issued its ruling on June 17 in the case of Superior Lawn Care v. WCAB. The opinion is available on the court's Web site.
