Attorney fees in workers compensation cases includes paralegal expenses, Supreme Ct. rules

(7/28/2004) - Fees for paraprofessionals such as paralegals and law clerks may be recovered as a component of an award of attorney’s fees under the Pennsylvania Workers’ Compensation Act, the state Supreme Court decided on July 22 in Vitac Corporation v. WCAB (Rozanc). In a 10-page opinion written by Justice Saylor, the Court determined that “attorney’s fee” in Section 440(a) of the Act “includes reasonable fee for legal services rendered by paralegal, law clerks and recent law graduates.”
