Jury should have been instructed on res ipsa, Superior Court rules
The Superior Court held in Quinby v. Burmeister that the jury should have been instructed on res ipsa loquitur. The case involved a quadriplegic plaintiff's fall from a post-operating room table, which caused injuries that ultimately led to the plaintiff's death. The court overturned the jury verdict for the defense, ordered a liability judgment against them, and remanded for a new trial on damages. A copy of the opinion is available on the court's Web site.
