Auto Law: Employee recovering lost cell phone acting within scope of duties
under employer’s umbrella policy, Superior Ct. rules

(3/4/2023) -- A father who was killed in a motor vehicle accident along with one son and seriously injuring his other son was acting within the scope of his duties while attempting to recover a lost company cell phone, the Superior Court has ruled. In Leggett v. National Union Fire Insurance Co. of Pittsburgh, the Superior Court decided on March 2 that the employee was covered under an employer’s umbrella car policy for the accident. The Court also ruled that the determination by a Workers’ Compensation Judge was not collateral estoppel because of the difference in legal standards between Workers’ Compensation “scope of employment” and the insurance piolicy’s language “within duties.”
