Supreme Court overturns Commonwealth Court decision in Caso v. WCAB
(12/31/2003)--In a decision issued yesterday, the Supreme Court of Pennsylvania reversed the Commonwealth Court's decision in Caso v. WCAB. The court stated that vocational interviewers do not need to be pre-approved by the Workers' Compensation Bureau, as there are sufficient means of redress if an interviewer turns out to be unqualified. The court also ruled that the WCJ does have the authority to determine whether an interviewer is qualified under the Bureau's regulations.
