Separate policies not covered under UIM stacking waiver

(8/3/2023)--The Superior Court ruled on July 27, in Generette v. Donegal Mutual Insurance Co., that a signed UIM stacking waiver does not cover separate policies. The court decided that such a waiver would apply to UIM coverage under a multiple vehicle policy, however does not apply to the right to seek covereage from separate policies. The decision comes from a case where the plaintiff was a passenger in a vehicle that she did not own at the time of the accident. The full opinion can be found on the court's Web site.
