Senate Committee approves constitutional amendment ‘shell’ on caps

(2/10/2023) -- The Senate Judiciary Committee today voted 12-1 in favor of a bill that provides a legislative vehicle for a constitutional amendment on damage caps. The Senate will likely have a floor vote the week of March 8 or March 15. The bill contains no specific language on caps such as the type of cases to which it might apply (med mal, auto, products etc.) or the monetary limits that might be imposed.

The shell bill contains the necessary language to allow a referendum on a Constitutional amendment, and simply restates the current language of §18 of Article III of the Constitution.  Any limitations will be imposed by amendments to SB 9 offered from the floor in the Senate debate.
