New venue ruling from Superior Court panel

Motor vehicle accident case moved back to Philadelphia where registered address of corporation is located

(3/16/2006) - A Superior Court panel on March 8 in O’Donnell v. McDonough reversed by 2-1 a Philadelphia Common Pleas judge’s decision transferring venue of a personal injury action to Delaware County. The Superior Court panel determined that the trial court erred in finding that there was no basis for venue in Philadelphia County where the vehicle was owned by a business who’s registered address was in Philadelphia.

According to the opinion, the trial court in 2004 had sustained the defendants’ preliminary objection and transferred the case from Montgomery County (where the accident was thought to have occurred) to Delaware County, where the accident actually occurred.
